Defendant shall be punished by a fine of KRW 500,000.

Where the defendant fails to pay the above fine, one hundred thousand won shall be one day.

Punishment of the crime

No one shall operate any motor vehicle which is not covered by mandatory insurance prescribed by the Guarantee of Automobile Compensation Insurance Act on a road.

Nevertheless, the defendant operated the 124cc Oral Ba which was not covered by mandatory insurance at the time and place of the above Paragraph 1.

1. Article 70(1) and Article 69(2) of the Criminal Act to attract a workhouse;

The grounds for sentencing under Article 334(1) of the Criminal Procedure Act are as follows: (a) comprehensively taking account of the Defendant’s age, sexual conduct, family relationship, home environment, motive and means of crime, and all other factors of sentencing as shown in the argument of the instant case; and (b) the punishment shall be determined as ordered within the scope of the recommended punishment.

The favorable circumstances: (a) there is no record of criminal punishment before; (b) the commission of the instant crime; (c) the commission of the instant crime; and (d) the fact that a person entitled to basic living benefits could find it difficult to economic circumstances; (c) the Defendant operated an unregistered diaba without mandatory insurance; and (d) the Defendant caused a traffic accident while operating a unregistered diaba; and (c) the Defendant caused personal and material damage.
