A defendant shall be punished by imprisonment for two years.

The defendant shall be liable to the applicant K for the compensation of KRW 1,324,00,00.

Punishment of the crime

On March 15, 2017, the Defendant was sentenced to one year and two months of imprisonment for fraud in the Militarysan Branch of the Jeonju District Court on March 15, 2017, and completed the execution of the sentence in the Net Prison on October 8, 2017.

In fact, the Defendant did not have goods, such as hand-on cases, performance pockets, sports tickets, contact diskettes, etc., so even if others receive money as the price for goods, there was no intention or ability to send the said goods.

On October 11, 2017, the Defendant posted a notice on the Defendant’s home located in the Sinsan-siO to sell a Handphone case to the “P” website, and made a false statement to the effect that the Defendant would send a handphone case to the victim Q Q who reported and contacted this to the victim Q Q who wired money.

The Defendant received 30,000 won from the injured party to the Defendant’s account under the name of the Handphone case price on the same day.

The Defendant, including this, received a total of KRW 2,214,50 from around 10 to November 12, 2017 by deceiving victims over ten times, as indicated in the list of crimes in Attached Table 1.

In this respect, the defendant, by deceiving victims, acquired financial benefits.

Since the Defendant did not have goods such as contact diskettes, the Defendant did not have an intention or ability to send goods such as contact diskettes even if he received money from others under the pretext of the price of contact diskettes.

On December 16, 2017, the Defendant posted a letter on the Defendant’s mother located in Sinsan-si on the Internet site “P” at around 16, 2017, and falsely told the Defendant to send a contact book to the VictimJ who reported and contacted the book to transfer money.

The Defendant received 210,000 won from the injured party to the S account under the name of the price for the same day.
