1. The Defendant’s disciplinary action for one month of suspension from office against the Plaintiff on February 20, 2012 shall be revoked.

2. The costs of the lawsuit are assessed against the defendant.

1. Details of the disposition;

A. (1) A post office located in Ansan-si B is a special post office under Article 2(1)1 of the Special Post Offices Act, and D is a designee under Article 2(1)2 of the Special Post Offices Act.

(2) The Plaintiff is appointed as the director general of C post office on the recommendation of D and serves as C post office on November 3, 2008.

B. The Board of Audit and Inspection who audited the operational status, etc. of the system of the recommended postmaster of a special post office conducted an audit on and around December 201, 201, and conducted an audit on and from January 1, 2007 to 30 persons recommended by the head of a special post office, 15 persons, including the Plaintiff, provided money and valuables to his/her designee in return for the recommendation of the head of a special post office. As a result, the Board of Audit and Inspection confirmed that 15 persons, including the Plaintiff, provided money and valuables to his/her designee. Of them, the Plaintiff arbitrarily withdrawn the postal deposit handling fees deposited in C post office deposit accounts (hereinafter “instant deposit account”) from December 1, 2008 to April 1, 201, and demanded the dismissal of the Plaintiff.

C. (1) On February 14, 2012, the Defendant requested a resolution by the Board of Audit and Inspection to the Special Post Office Disciplinary Committee for the Plaintiff.

(2) The Special Post Office Director Disciplinary Committee arbitrarily withdraws the commission for postal savings deposited into the instant deposit account and pays it to D, which constitutes grounds for disciplinary action. However, taking into account the Plaintiff’s attitude of service and C post office’s management performance, the disciplinary action was taken for one month of suspension from office against the Plaintiff.

On February 20, 2012, the defendant is the regional administration of the Republic of Korea.
