The defendant A shall be punished by imprisonment for six months.

However, the above sentence shall be executed for two years from the date of the final judgment.

Criminal facts

1. The Defendants’ co-principal (violation of the Act on the Punishment of Arrangement of Commercial Sex Acts, Etc.) committed an act of arranging sexual traffic (hereinafter “D”) by leasing the room room around March 1, 2016, Kimhae-si C 101, 102, and 302 around March 1, 2016. Defendant A, as the owner of the said establishment, is responsible for the overall operation of the said establishment, and Defendant B, as an employee of the said establishment, conspired to take charge of duties such as reservation management, customer guidance, etc.

On March 10, 2016, at the above business establishment around 19:30 on March 10, 2016, Defendants arranged commercial sex acts by inducing a female to engage in similar acts, such as inducing the sexual intercourse of the solar nationality, which is waiting for the above business establishment by receiving 70,000 won from the police officer who pretended to be a customer, leading the female sexual intercourse of the solar nationality, and inducing the female to engage in such similar acts. From March 3, 2016 to March 10, 2016, Defendants arranged commercial sex acts by inducing six unspecified male customers to engage in sexual intercourse or similar acts by receiving 60,000 won or 1.20,00 won per person from the unspecified male customers.

2. Defendant A’s sole criminal conduct (a violation of the Act on the Punishment of Arrangement of Commercial Sex Acts, Etc. (a sexual traffic advertisement)) (a violation of the Act on the Punishment of Commercial Sex Acts, Etc.) paid KRW 300,000 per month to the Internet “E” site from March 3, 2016 to March 10, and (b) placed an advertisement of a business establishment where sexual traffic or arrangement of commercial sex acts, etc. was performed by inserting the contents “10,000 won per month” along with the pictures of the women who are sleeped by themselves while introducing the said business.
