A shall be punished by imprisonment without prison labor for eight months, and by imprisonment without prison labor for six months.

However, this judgment is delivered against Defendant A.

Defendant

A works as a preparatory engineer of the Korean Railroad driving technology affiliated with A and is a railroad engineer who is engaged in the duties of transportation (such as moving, separation, combination, change of tracks, etc.) of the F Station in Dongdaemun-gu Seoul Metropolitan Government at the place of business of the F Station in Dongdaemun-gu, Seoul, and who moves the power vehicle according to the signal apparatus and the sign of entrance exchange.

Defendant

B is a person who works as a front of the service affiliated with the K Integrated Service and engages in the front duty to induce the safe entrance and exit of the engine vehicle through the front of the engine's replacement work (man signal).

On January 12, 2015, at around 17:07, the Defendants: (a) returned the power-driven vehicles of No. 8225 located on the tracks No. 8225, located within the Gu of the said F Station; and (b) were ordered to transport the said vehicles to the inspection line No. 21; (c) Defendant A entered the said engine’s driver’s seat on the said engine’s line; and (d) carried the said engine on the line at the entrance of the said engine at the entrance of the line No. 18; and (c) Defendant B continued using approximately 8km speed at the speed of 11km in accordance with the line transition line No. 18; and (d) Defendant B, on the opposite side of the said “11B” line transition line shift, the said power-driven vehicles set up a transition engine to “11B”, and changed the direction of the said engine to the front direction of the said engine to the direction of the said engine.

In such a case, the power-driven vehicle is driving the engine vehicle at the driver's room located on the front direction of the power-driven vehicle, and it is in line with the guiding direction of the power-driven vehicle, in order to prepare against the situation of the power-driven vehicle, etc., by driving the engine vehicle at the driver's room located on the front direction of the power-driven vehicle, in order to prevent any person from spreading the vehicle without permission, before starting the said power-driven vehicle.
