A defendant shall be punished by imprisonment for one year.

The defendant shall pay 250,000 won to D who is an applicant for compensation.

This order shall be issued.

Punishment of the crime

around September 6, 2018, the Defendant: (a) connected the Internet SNS “SNS” by using smartphones at the Defendant’s residence of the F apartment G of Daegu-gu, Daegu-gu, 2018; and (b) made a false statement to the effect that “I will sell the clothing”; (c) the victim H was defective in contact with the victim; and (d) the victim “I will send 143,000 won to the victim.”

However, since the defendant did not have the intention to sell the goods to the victim, even if he receives money from the victim, he did not have the intention or ability to sell the goods to the victim.

As above, the Defendant, by deceiving the victim as above, received 143,000 won from the victim’s I account in the name of the Defendant, and received 143,000 won from the victim, and acquired 817,000 won in total from the victims through 8 times from that time to January 6, 2019, as stated in the attached crime list (the text of the judgment).

1. On January 8, 2019, the Defendant, at the Defendant’s residence located in the Daegu-gu, Daegu-guJ, published a false statement that “Once you transfer KRW 116,00,00 to the victim L who reported and contacted the statement,” using a mobile phone, the Defendant did not have any intent or ability to sell the statement even if he received the payment from the victim.

The Defendant, by deceiving the victim as above, received KRW 116,00 from the victim’s M bank account (N) in the name of the Defendant on the same day, and received total of KRW 9,096,000 from that to May 7, 2019, as shown in the separate list of crimes (1).

Accordingly, the defendant, by deceiving the victims, acquired property from the victims.
