A defendant shall be punished by imprisonment for not less than eight months.

Punishment of the crime

On September 18, 2017, the Defendant posted a false statement to the effect that “I will send a bank if I send money.” The Defendant sent a false statement to the effect that “I will send a bank to I wish to send money.”

However, even if the defendant receives money, he did not have the intention or ability to send theme bank.

The defendant deceivings the victim as above and transferred 80,000 won to the Nonghyup Bank account (Account Number D) in the name of the defendant from the victim.

The Defendant, including that, from around that time to October 12, 2017, by deceiving the victims on a total of three occasions, as shown in the List of Crimes (1) from that time, and then deceiving the victims on a total of 360,000 won from the victims.

1. On December 8, 2017, the Defendant, at the victim E’s home located in Eunpyeong-gu Seoul Metropolitan Government FBB and 302, posted a false statement to the effect that he/she sells fishing products to the NAV and the Korean carpet, using smartphones, and reported and contacted the statement to the effect that “if he/she transfers money, he/she will send money, he/she will send fishing products.”

However, even if the Defendant receives the price of goods as above, the Defendant sent the above fishing goods.

there was no intention or ability to act.

Nevertheless, the defendant deceivings the victim as above and transferred KRW 155,00 as the price for goods on the same day to the victim.

2. On December 9, 2017, the Defendant, at the victim G, posted a letter to the effect that he/she sells fishing products using smartphones at the places listed in paragraph (1) around December 9, 2017, and false statement to the effect that “the Defendant would send money to the victim G who reported and contacted with this fact.”

However, the defendant does not have the above fishing products at the time of the fact.
