A defendant shall be punished by imprisonment for a term of one year and eight months.

The defendant shall pay 100,000 won to the applicant for compensation with the money obtained by deceit.

Punishment of the crime

On December 21, 2017, the Defendant had been sentenced to imprisonment with prison labor at the Suwon District Court for fraud, etc. on December 21, 2017, and completed the execution of the sentence in the Daegu Prison on August 23, 2019.

Criminal facts

1. Larceny;

A. On February 8, 2020, the Defendant: (a) around 03:00 on February 8, 2020, opened and entered a door in front of the Seogu Seo-gu Seo-gu, Daegu, Seo-gu, Seoul, on February 8, 2020, that is, the victim D, parked at that door, did not correct the E rocketing car; and (b) took one copy of the F Bank Postal Card, which is the victim’s possession in the next custody of the driver’s seat, and stolen it.

B. On February 8, 2020, around 12:30 on February 8, 2020, the Defendant opened and entered a door in front of the Daegu-gu GGG lending, Daegu-gu, on which the victim H owned by the victim, parked at that door, the Defendant: (a) opened a door in front of the ISP car; and (b) entered the old half of the old half of the KRW 500,000, the market price of which is 100,000,000 per the new half of the KRW 1,00,000,000 per the market price; (c) one 1,00,000,000,000 won per the new half of the gift certificates per the market price of the company bank; (d) 1, 1, 1,2, 2, 2, 3,000,000 won per the 1,000,000 won per the Plaintiff’s own.

2. Fraud or violation of the Specialized Credit Finance Business Act;

A. On February 8, 2020, around 12:37, the Defendant, at around 12:37, paid the amount by using a credit card (P) of H bank under the name of H, which was stolen, as described in paragraph 1(b), as the legitimate owner of the said card, from the “O” clothing sales store operated by the victim N in Daegu-gu, Seo-gu, M, a total of the market value of KRW 668,00,000.

Accordingly, the defendant, by deceiving the victim, acquired economic benefits equivalent to the above payment, and used the stolen credit card.
