A defendant shall be punished by imprisonment for not less than eight months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

1. The Defendant, at around 00:30 on June 27, 2015, obstructed performance of official duties by police officers C, on the ground that, under the influence of alcohol on the street side of the E-district located in Yongsan-gu, Yongsan-gu, Yongsan-gu, Yongsan-si, Goyang-si, the Defendant sent a taxi engineer F with a trial expense, and recommended C to stop the Defendant who gets out of the scene and return home to the scene after receiving F’s report while disputing F, the police officer called up for a disturbance at the Hansan Police Station E-gu, Busan Police Station E zone C, which was called up to the site, and urged C to stop back the Defendant who gets out of the disturbance and return home.

Accordingly, the Defendant interfered with the legitimate execution of duties by police officers concerning the handling of 112 reported cases.

2. 경찰관 G에 대한 공무집행방해 피고인은 같은 날 01:00경 제1항 기재 E지구대 사무실에서 위와 같은 이유로 현행범인 체포되어 위 지구대에 인치되자 “수갑 풀어 개새끼야, 내가 다음날 찾아와서 다 끝장낸다, 이 씨팔놈아, 의경새끼야!”라고 욕설하며 탁자와 보호유리를 발로 차고 이에 순경 G이 피고인을 제지하자 G의 허벅지를 발로 찼다.

Accordingly, the defendant interfered with legitimate execution of duties concerning the police officer's surveillance and the management of personal illness.

3. 경찰관 H, I에 대한 공무집행방해 피고인은 위와 같은 이유로 일산경찰서 형사과에 조사를 받게 되자 이에 앙심을 품고 같은 날 05:00경 위 지구대로 다시 찾아가 그곳에서 근무 중인 경위 H에게 “야, 빡빡아, 내가 다시 찾아온다고 했지, 씨팔놈아, 빡빡이 대머리 새끼야!”라고 큰 소리로 욕설하며 지구대 안으로 들어가려고 하여 H이 피고인에게 귀가를 권유하며 지구대 진입을 제지하자 H의 오른팔을 강하게 잡아당기고, 경장 I이 이를 말리자 “어린 놈의 새끼가, 씨팔놈아!”라고 욕설하면서 I의 팔을 강하게 잡아당겼다.

Accordingly, the defendant has a legitimate performance of duties by police officers who are on the earth's boundary.
