1. The plaintiff's claim is dismissed.

2. The costs of lawsuit shall be borne by the Plaintiff.

1. Basic facts

A. On May 26, 2014, the Plaintiff entered into a contract with the Defendant, et al., for purchasing approximately KRW 16,363 square meters (4,950 square meters) of five parcels, Nam-si, Namyang-si, and the Plaintiff, as indicated below, to exclude approximately 18,321 square meters of the land subject to sale or purchase, or the area equivalent to approximately 1/2 of the access road, which the seller would again undergo a transfer of ownership, from the sale or purchase area as indicated below. As such, the Plaintiff agreed to exclude approximately 16,363 square meters of the total area of the above area, excluding the area equivalent to 1/2 of the access road, from the total area of the above area, as the area subject to the contract (hereinafter “instant sales contract”). The specific details of the land subject to sale are as listed below [mark].

9.The 1/2 of the road site to be newly constructed in the land subject to this sale will, upon completion of the designation of the road, transfer the seller's ownership in the future and will not be given or received in cash.

The exclusive expenses to be borne by each party on the road site shall be borne by each party on the road site to the extent of the area.

(Provided, That if there is a better method in the administrative process prior to any balance, it shall be dealt with through consultation). Even after the transfer of the sale and purchase of real estate, the whole land owned by the seller and all necessary procedures (such as acceptance of use, designation of roads, purchase, etc.) and requirements for the permission or progress of the construction shall not be interrupted in administration, regardless of the reasons between the seller and the buyer.

10. The sales amount under the sales contract shall be 16,363 square meters (4,950 square meters) excluding the area of 1/2 of the road site as stated in paragraph 9 of the said special agreement by the seller.
