1. The part of the judgment of the first instance, including the claim modified by this court, against the Defendants is as follows.
Reasons
1. Facts of recognition;
A. 1) The details of the division of the instant land and the change of ownership are as follows: K forest land 10,116 square meters (hereinafter “land before division”) in Gunsan-si.
(2) On September 4, 2006, upon filing a lawsuit against the Republic of Korea to confirm that the sole heir BC of AZ and the sole heir of AX own 1/7 shares of each land before subdivision (AU, AV, AW, AY, and BA) own 1/7 shares of each 1/7 shares of each 1/7 shares in the forest register as unregistered land. The judgment of acceptance was rendered on January 4, 2006, and the judgment became final and conclusive as is.
(B) On April 13, 2006, BB and BD filed a lawsuit claiming a partition of co-owned property on the land prior to partition on April 12, 2006, after purchasing 1/7 shares in the land from BC on April 20, 2006, B and BD filed a lawsuit against the title holder of five circumstances on May 12, 2006 (No. 2007Gadan39165). On January 1, 2008, B and BD divided B and BF from the land prior to partition according to the final judgment of co-owned property partition, according to the final judgment of co-owned property partition.
5) Accordingly, 7,226 square meters of K Forest in Gunsan-si remaining after being divided (hereinafter “instant land”).
The AU, AV, AW, AY, and BA own each 1/5 shares. (b) The Plaintiffs and the Intervenor succeeding to the Plaintiff are equity right holders of the instant land. At the end of the pleadings, the Plaintiffs and the Intervenor succeeding to the Plaintiff are equity right holders of the instant land. At the end of the pleadings, the shares owned are as follows. The shares owned by them exceed the majority of the shares owned by the instant land.
