Defendant shall be punished by a fine of KRW 7,000,000.

When the defendant does not pay the above fine, 100,000 won.

Punishment of the crime

[2018 fixed-term 930] On December 12, 2017, the Defendant posted an advertisement on Internet B B B B B B B, “C” as if he/she received an application for side business, and falsely stated that “In order to continue side business, 200,000 won is required” to the victim D who applied for side business.

However, even if the defendant received the deposit from the victim, he did not have the intention or ability to request the side business.

Nevertheless, the defendant received 200,000 won from the victim's account under the E name of community credit cooperatives (F).

[2018 Highly 931] On January 3, 2018, the Defendant posted an advertisement stating that “Granum work is sought” on BY G Bag G website B, and reported it to the victim H (Y, 30 years of age) who contacted the Defendant, first deposit KRW 50,000 with the materials to the victim H (Y, 30 years of age) who sent the materials. If the Defendant sent the materials and received them and sent them after completion of the craft, he/she would deposit KRW 50,000 with the material cost deposit and KRW 25,000.”

However, the defendant did not have the intention or ability to pay properly the deposit and the water-related expenses even if he received the material deposit and water-related craft.

Around January 3, 2018, the Defendant, by deceiving the victim as above, received KRW 50,000 as a security deposit through the National Bank (Account Number:J) in the name of the victim, and received KRW 50,000 from the victim on January 10, 2018, but did not pay KRW 25,000, in total, from the victim.

1. On December 5, 2017, the Defendant committed the crime against the Victim K, at the Defendant’s house located in the Bupyeong-si L apartment M, posted a notice on the Defendant’s personal b car page on the Defendant’s personal b car page, and reported and contacted the notice, and then deposited KRW 200,000 on the condition of side business to the Victim K (n, 32 years old).
