A defendant shall be punished by imprisonment for not more than ten months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

The Defendant, “2019 Highest 4135,” even though he is not a person handling narcotics, dealt with the following psychotropic drugs-related Mebacules (one philopon; hereinafter “philopon”).

1. Purchasing philophones;

A. On February 25, 2019, the Defendant, at the Defendant’s house located in Jung-gu Seoul Metropolitan Government B and C, remitted KRW 400,000 from his D account to E bank account in the name of E designated by the seller of penphones under the pretext of the purchase price of penphones, and at around 23:10 on the same day, the Defendant purchased phiphones by means of searching approximately 0.3g of phiphones from the 2nd floor of Bara in Gangnam-gu Seoul Metropolitan Government, which is the place where the phiphones are concealed.

B. On March 6, 2019, at around 21:05, the Defendant transferred KRW 420,000 from the H bank account to the said F bank account under the name of the purchase price for phiphones, and on the same day, the Defendant purchased phiphones by finding approximately 0.3g of phiphones in the vicinity of the French-gu Dok-dong, Seoul, which is the place where phiphones are concealed.

C. On March 15, 2019, at around 19:30, the Defendant, at around 19:30, had I transfer KRW 4.20,00 to the said F bank account. At around 22:30 on the same day, the Defendant purchased phiphones by means of searching approximately 0.3g of phiphones from the phiphones near the Doll stairs located in Gangnam-gu, Seoul.

On March 24, 2019, the Defendant: (a) transferred KRW 400,00 from the said D account to the said F bank account under the name of Handphone purchase price; and (b) purchased phiphones by means of sending approximately 0.3g of phiphones from the non-discilable loan located in Songpa-gu Seoul, Songpa-gu, Seoul, the place where phiphones are concealed on the same day at night.

2. On March 21, 2019, the Defendant: (a) had the said I transfer KRW 400,000 to the said F Bank account on March 21, 201; and (b) had the said I transfer the said F Bank account on the same day.
