1. On the Plaintiff (Counterclaim Defendant),
A. Defendant B: (a) KRW 310,000,000 and its related thereto from October 20, 2016 to November 23, 2017.
Reasons
Facts of recognition
On July 29, 201, the Plaintiff entered into a sales contract for forest land and changed the said contract with Defendant F. The portion of 8,372 square meters out of 7,474 square meters of G forest and H forest and 28,682 square meters in Nam-si, Namyang-si (after the area was adjusted to 8,725 square meters of the said part, it was subdivided into 8,725 square meters of I forest and 8,725 square meters on December 15, 201; hereinafter “the instant land” was added to 250,000 won on the date of contract, and the intermediate payment is KRW 75,00,000,000 is paid within seven days after the completion of development activities on each of the said contracts (hereinafter “instant permission”), and the buyer was paid the remainder of the said land as the sale contract within the period of 200,000 won on the said land and the sale contract within the said period of 27,2011.
Meanwhile, Defendant F paid the Plaintiff the said down payment of KRW 250 million (hereinafter “instant down payment”) on the same day.
On August 10, 2011, the Plaintiff received the registration of transfer of ownership with respect to the instant land from J.
While the instant permission was not granted on the instant land, the Plaintiff’s payment date is up to December 20, 201, instead of increasing the intermediate payment to 1.2 billion won on the basis of the instant sales contract, and the payment date is up to December 20, 201; the total sales amount is reduced to 2.45 billion won; and the remainder is reduced to 1 billion won; the remainder is paid as the delivery of documents necessary for the registration of transfer of ownership and simultaneous performance; and the remainder is to be paid within three months after the instant permission is granted; and the period is to be paid as of July 20, 2012; and the instant change is referred to as the “instant change contract” (hereinafter referred to as the “instant change contract”).
