1. All of the plaintiff's claims are dismissed.
2. The costs of lawsuit shall be borne by the Plaintiff.
Reasons
1. Determination as to the cause of claim
A. The plaintiff's assertion 1) The defendant is obligated to pay the plaintiff a total of KRW 143,00,000 (=63,000,000,000) and damages for delay in addition thereto, if the defendant had no intention to marry with the plaintiff, actively deceiving the plaintiff as if he were to marry and delivered the plaintiff with respect to living expenses of KRW 63,00,000,000, and 70,60,000,000. The defendant has a duty to pay the plaintiff a total of KRW 143,00,000,000,000,000,000 as damages for tort, and then, if the defendant had an intention to marry with the plaintiff, the plaintiff and the defendant delivered the living expenses, vehicles, etc. as a result, and the defendant reversed the conclusion of the matrimonial engagement without justifiable cause.
B. 1) First, it is difficult to recognize that the statement of evidence No. 1, No. 4, and No. 5 regarding the claim for damages based on unlawful acts by deceiving the Defendant that the Defendant had an intention to marry even without the intent to marry with the Plaintiff, thereby deceiving the Plaintiff with automobile, visibility, living expenses, etc. It is difficult to accept the Plaintiff’s assertion. 2) Next, we examine the claim for return of unjust enrichment premised on the cancellation of matrimonial engagement.
The acceptance of the matter of matrimonial engagement is accepted for the purpose of proving the establishment of matrimonial engagement and promoting the liquidation of the parties and the quantity thereof. Thus, in special circumstances, such as where the recipient of the matter of matrimonial engagement has no intention to continue the marriage in good faith from the beginning of the marriage and where it is recognized that the subject of the case has caused the strike of marriage, the obligation to return the matter of matrimonial engagement corresponding to the case of failure of marriage in light of the good faith and the principle of equity.
