Reasons
Punishment of the crime
Unlike general funds loans, the loan of the Housing Finance Corporation is limited to a person who has the intention or ability to purchase a house, and the person to receive the loan is limited to a person who has the intention or ability to purchase a house if he/she prepares a false application for the loan or submits false data intentionally.
Defendant
The following crimes were committed by using false loan documents to obtain a loan from the Jung-gu Incheon Metropolitan Government apartment B (hereinafter “instant apartment”) under the name of the purchase of apartment house B (hereinafter “instant apartment”).
The Defendant, together with C, led the entire crime by taking charge of the fund necessary for the loan fraud crime such as the cost of issuing a false appraisal report, sharing the roles of D and E to co-offenders, and F is the role of fund management, G manager H is the role of preparing a false sale contract, G manager, and L is in contact with the appraiser belonging to the appraisal corporation and receiving a false appraisal report with the appraisal value lower than the market price, and M and N are engaged in the role of receiving a loan application by submitting related documents such as a false sale contract to the damaged company.
Accordingly, on November 2005, the Defendant paid KRW 180,000,000 to C for the commission of the crime two times at the Buddhist land below Incheon, and C purchased apartment units of this case by requesting D, E, I, J, K, and L to prepare a false appraisal report by requesting the appraiser P belonging to the O corporation and the staff Q to prepare a false appraisal report, which is merely KRW 135,00,000,000 in the market price from P, Q to receive a false appraisal report, and F to provide loans to the living information area.
