A defendant shall be punished by imprisonment for one year.

However, the execution of punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

피고인은 2013. 3. 27. 18:00경 서울 종로구 C에 있는 D 음식점에 혼자 들어가 술과 고기를 주문하여 먹다가, 옆 테이블에 있던 피해자 E(38세)의 일행들이 너무 시끄럽게 떠든다는 이유로 시비가 발생하자, “야, 너희들은 짱꼴라 새끼들이야. 중국새끼들은 위험한 새끼들이야. 다 죽어야 돼.”라는 등 욕설하다가 등산용 배낭에서 흉기인 손도끼(길이 18cm , 망치ㆍ접이식 칼 등이 달린 다용도)를 꺼내어 들고 피해자에게 다가가 “내가 이런 사람이야”라고 말하며 흔드는 등 위험한 물건을 휴대하고 협박하였다.
