1. Determination on the cause of the claim
A. Basic Facts 1) The Defendant related to the Plaintiff, Seojin Construction Industry, Inc., entered into a subcontract with the Plaintiff, Seojin Construction Industry, Inc., on or around August 2012, with respect to the portion of the tin Corporation among the “Saria Kindergarten Construction Project,” which was ordered by the Daegu-gu Foundation for the Maintenance of Seocheon-gu, Daegu-gu. The specific details are as follows. The subcontractor’s name: The contract amount on August 6, 2012: the period of construction of tin Corporation among the new kindergarten construction projects: the contract amount on August 15, 2012: 75,350,500 won: the supply price of 68,50,000 won (17,396,044 won): value-added tax of 6,850,000 won and the Plaintiff on August 15, 2012 (the date of completion of construction work under the above contract).
() From August 6, 2012 to October 25, 2012, the construction period was changed. The Plaintiff, the Seojin Construction Industry, upon consultation with the Defendant, entered into an agreement with the Defendant to change the construction period to the end of October. 25, 2012. The construction cost was KRW 5,271,200 (value 4,79,200 value-added tax of KRW 479,200). The Defendant paid KRW 60,975,00 to the Plaintiff Seojin Construction Industry in relation to the said tin Construction. The Plaintiff Seojin Construction Industry completed the said tin Construction Industry (hereinafter the Plaintiff Co., Ltd.) on April 2, 2012.
Specific contents are as follows: The construction period of tin construction from among the new construction works in the Seo-gu, Seo-gu, Seo-gu, Daegu-si, on April 2, 2012: the contract amount on August 31, 2012: 45,500,000 won: value-added tax amounting to 414,090,909 (Labor cost: 85,596,192): the Defendant paid KRW 41,409,091 in relation to the above tin construction industry until now, the Plaintiff paid KRW 380,00,000 in relation to the said tin construction industry.
