Reasons
1. Basic facts
A. Defendant Samwon E&D Co., Ltd. (hereinafter “Defendant Samwon”) contracted part of the New Construction from Daewoo Construction Co., Ltd. (hereinafter “instant New Construction”). On August 15, 2012, Defendant Sami International Co., Ltd. (hereinafter “Defendant Sami”) determined and subcontracted the instant New Construction as KRW 808,500,000 for construction cost (including value-added tax) among the New Construction Works.
B. Around November 2012, Defendant Sero had V perform 107 tin works at the instant new construction site via C, and around January 2013, Defendant Sero had the Plaintiff representing the Plaintiff, etc. perform the said field 110 tin works.
C. The Plaintiff et al. received safety education from Defendant Samwon before commencing the said tin work, and Defendant Se-ro, via the field staff, prepared a personnel inspection list recording the Plaintiff et al.’s on-site input and the actual working hours, and supervised the Plaintiff et al.’s attendance and work by ordering the Plaintiff et al. to work for tin works, and provided supplementary materials necessary for the said work.
Around February 2013, V agreed to pay KRW 180,000 per day to the Plaintiff as well as KRW 150,00 per day on the basis of the above personnel inspection table on the part of the Plaintiff et al., ordering the Plaintiff et al. to perform the above 107 tin works together with the above 110 tin works (hereinafter “instant tin works”).
E. During the construction of the instant stone, the Plaintiff, etc. received KRW 60,000,000 from Defendant Siro on January 8, 2013; KRW 14,349,300 on March 4, 2013; KRW 1,000,000 on March 25, 2013; KRW 10,000 on April 3, 2013; KRW 4,000,00 on April 8, 2013; KRW 5,00,000 on May 10, 2013; and KRW 60,000,000 on a daily basis from Defendant Samwon on June 3, 2013; and KRW 930,90 on a daily basis until April 3, 2013.
F. The plaintiff et al. is a daily allowance for the instant stone construction work.
