Punishment of the crime

The Defendant is a guardian of C (12 months after birth) of a patient who has received medical treatment in an emergency room of the Chungcheongnam-si University Hospital located on the 776 street in the Cheongju-si, Seocho-gu, Cheongju-si.

No person shall interfere with the rescue, transfer, emergency treatment, or medical treatment of an emergency patient by persons engaged in emergency medical services by means of violence, intimidation, deceptive scheme, threat, or other means, or destroy, damage, or occupy medical facilities, equipment, medicines, or other instruments for emergency medical services provided by a medical institution, etc.

그럼에도 불구하고, 피고인은 2015. 11. 29. 19:40 경 충북 대학교병원 응급실에서 위 병원 응급실 근무 의사인 피해자 D가 응급환자인 C에게 수액을 투여하면서 주사바늘을 꽂은 것으로 인해 우측 손등 등이 부어올라 이에 대해 다른 치료를 요구하였으나 피해 자가 피고인의 요구를 무시하면서 치료를 해 주지 않는다는 이유로 다른 응급환자를 진료하고 있던 피해자에게 다가가 우측 발로 피해자의 좌측 발목 뒷부분을 1회 걷어차고, 이에 피해자가 자리를 피한 후 다른 의사와 응급환자들의 상태에 대해 논의하자, 피해자를 뒤 � 아가 우측 손으로 피해자의 뒷덜미 부위를 잡아당긴 다음 우측 손으로 피해자의 좌측 얼굴 부위를 1회 때렸다.
