The prosecution of this case is dismissed.

1. On September 19, 2016, the Defendant: (a) at the counter of the branch office D of the Gwangju Bank located in Gwangju Nam-gu, Nam-gu, Gwangju on September 19, 2016; (b) on the ground that the Defendant’s whereabouts of KRW 10 million among the term deposits terminated on May 4, 2016 is not confirmed; (c) on the ground that the Defendant’s employees and clients reported, E and other bank employees and the victim F in charge of withdrawal carried out the withdrawal, “10 million won went away anywhere; and (d) money was collected, as a means of imposing tax on, and adding money to, fraud.

In a large sense, “the victim was insulting.”

2. Determination:

(a) An offense subject to victim's complaint (Articles 311 and 312 (1) of the Criminal Act);
