A defendant shall be punished by imprisonment for not more than ten months.
Reasons
Punishment of the crime
To the extent that it does not interfere with the defendant's right of defense, some of the facts charged are legally adopted and investigated by this court.
1. From May 2012, the Defendant violated the Act on the Protection and Management of Wild Fauna and Flora (hereinafter “D”) closed the business of operating a poppy farm with the trade name “D” in the Namyang-gun, Namyang-gun. From May 2016 to May 2016, the Defendant, who operated “G” trillion from E along with E, was willing to import and sell the poppy eggs from the Republic of Korea via the H of Han Man-man’s nationality, an internationally endangered species, such as poppy eggs.
(a) No person who has imported internationally endangered species poppy shall export, import, take out or bring in internationally endangered species and products processed therefrom without obtaining permission from the Minister of Environment;
Around January 1, 2013, the Defendant, in collusion with the foregoing H, imported an amount equivalent to KRW 5 million for internationally endangered species of poppy 5 million, without obtaining permission from the Minister of Environment. From that time, until October 15, 2016, the Defendant closely imported a total of KRW 290,603,860 in total over 40 times, such as the list of crimes in the attached Form (1) in the same manner, from October 2016.
(b) No person who has transferred internationally endangered species poppy shall capture, collect or purchase, transfer or acquire, arrange for transfer or acquisition, possess, possess, occupy, or display international endangered species and products processed therefrom exported, imported, taken out, or brought in without obtaining permission from the Minister of Environment;
The Defendant, without the permission of the Minister of Environment, transferred the internationally endangered species poppy to I around September 2, 2012, after receiving KRW 2.60,00,00 from around September 2, 201, and thereafter, from around October 17, 2016, the Defendant 492,525,000 in total over 538 times as shown in the annexed crime sight table (2).
