1. The Defendant: (a) KRW 58,890,000 for the Plaintiff and the Plaintiff’s KRW 5% per annum from April 11, 2014 to September 3, 2014; and (b) September 4, 2014.

1. Presumed facts

A. The Plaintiff is a company that runs the retail and distribution business in remote areas with the trade name of “B,” and the Defendant is a company that runs the construction business, indoor decoration construction business, aesthetic and waterproof construction business, etc.

B. On September 30, 2013, the Defendant entered into a construction contract with C on September 30, 2013, with respect to the construction work cost of KRW 67,830,000 with respect to the “Seimcheon-do Construction Work among the Construction Works of Multi-unit Housing D,” and on October 20 of the same year, with respect to the construction work cost of KRW 228,501,90 with respect to the “Sesan Emar Emar Construction Works among the Construction Works of New Emar Emar (hereinafter “Semar Emar Emar Construction Works”), and on the same day, with respect to the construction work cost of KRW 78,976,00 with respect to the construction work cost of KRW 78,97,00 among the Construction Works of F Tools (hereinafter “F apartment Emar”)

C. On December 26, 2013, while the Plaintiff entered into an agreement on the construction works of the Dogwon and the Defendant, the Plaintiff, upon receiving a request from the Defendant to provide additional human resources to the site of “two construction sections dunes Dog Construction Works” on December 26, 2013, agreed to be directly paid the construction cost calculated as KRW 135,00 per worker upon receipt of a request from the Defendant to provide them with additional human resources. From December 21, 2013 to January 24, 2014, the Plaintiff completed the construction work by inserting 507 human resources in total at the construction site at the above site (as December 72, 2013, January 435, 2014), from December 21, 2013 to January 24, 2014).

(hereinafter “instant construction work”). The sum of the construction cost as above is KRW 68,445,00 (=135,000 per day x 507).

On February 20, 2014, the Plaintiff agreed to be directly paid the construction cost calculated by KRW 135,000 per worker per worker upon receiving a request from the Defendant to employ human resources at the site of the Domsan E Apartment Welfare Center. From February 20, 2014 to February 21, 2014, the Plaintiff included the total of seven human resources at the construction site and completed the construction work.
