The judgment below is reversed and the case is remanded to Seoul High Court.

The grounds of appeal are examined (to the extent of supplement in case of supplemental appellate briefs not timely filed).

1. The lower court, based on its adopted evidence, published and published a thesis in 2004 with the content that the Plaintiff established M-1 embryonic stem cell reproduction from human body in the 2004 J on February 2, 2004. The examination of the analysis of genes (the examination to confirm whether the gene genes extracted from somatic cell cells and stem cell cells are established by comparing and analyzing the identity of the genes extracted from somatic cell cells and stem cell cells, and the examination of whether the stem cell system was established by somatic cell reproduction was operated by the researchers of the Plaintiff’s research team, and the Ma-1 stem cell line (the examination method of confirming the diversification of stem cell cells, one of the two methods of confirming the 10-1 stem cell line and the 1-2-year stem cell line formation of the Plaintiff’s stem cell cells from the 20-year stem cell paper, and the Plaintiff’s research institute was also established with the 10-year embryonic stem cell paper from the 20-year stem cell paper (the 20-year stem cell paper).
