A. The Plaintiff is a police officer belonging to the Namdong Police Station of Incheon Regional Police Agency.

From January 29, 2015 to December 7, 2016, the Defendant: (a) deemed that the Plaintiff violated Articles 56 (Duty of Good Faith) and 63 (Duty of Maintenance of Dignity) of the State Public Officials by performing the following acts while serving as the commander of the Incheon Western Police Station B District; (b) on December 14, 2016, the Defendant issued a disposition of suspension from office for one month against the Plaintiff (hereinafter “instant disposition”) on December 15, 2016 based on the resolution of the General Disciplinary Committee of the Incheon Regional Police Agency.

(1) 성희롱 ㈎ 2015. 6. 26. 22:00경 C(여)의 오른손을 10여초간 잡아 성희롱(1차 성희롱) ㈏ 2015. 7. 일자불상 00:30경 C을 대장실로 불러 1시간여 동안 면담(2차 성희롱) ㈐ 2015. 8. 일자불상 03:30경 C이 쉬고 있는 여경휴게실의 방문을 갑자기 열고 C을 쳐다본 후 문을 닫음(3차 성희롱) ㈑ 일자불상 새벽시간대 노크 없이 화장실 문고리를 돌려 여경에게 불안감을 주고, 2015. 11.경부터 지구대 2층 여경화장실에서 수회 용변을 봄(4차 성희롱) (2) 순찰차 사적 이용 ㈎ 2015. 10. 일자불상경 01:00경 관내 술집 앞으로 순찰차를 보내도록 함 ㈏ 2015. 7.~8. 야간 부녀방범대원과 순찰차를 타고 지구대에 와서 대장실에서 30분 정도 머뭄 ㈐ 2016. 4.경 관내 술집으로 순찰차를 불러 중년의 여성과 함께 지구대로 와서 대장실에 30분 정도 머문 후 다시 중년의 여성을 순찰차로 귀가시킴 (3) 공무원으로서 부적절한 언행 자주 술을 마시고 지구대로 와 직원들에게 막말과 험담을 함
