피고인은 B, C, D, E과 2012. 3. 4. 05:30경 대전 서구 F 노래방에서, 보도방에서 속칭 “노래방 도우미”를 불러 함께 술을 마시던 중 일명 G이라는 노래방 도우미가 잘 놀지 못하고 버릇없이 행동하였다는 이유로 시비가 되던 중 위 G의 전화를 받고 보도방 업주인 피해자 H(21세)가 그곳에 오자, 피고인은 피해자에게 “안경 벗어, 보도가 똑바로 일하지 못하고 놀지도 못한다.”라고 소리치면서 손바닥으로 피해자의 왼쪽 뺨 부위를 2회 때리고, 그곳 테이블에 있던 양주병으로 때리려는 시늉을 한 뒤, 손바닥으로 피해자의 뒤통수 부분과 뺨 부분을 각 2회 때리고, B은 피해자에게 “싸가지 없다. 옆으로 오라.”고 소리치면서 양손으로 피해자의 뺨 부위를 8회 가량 때리고, 일행인 E, C는 각 이에 합세하여 피해자에게 “야 개새끼, 이리와 봐”라고 하면서 피해자의 뺨 부위를 각 2회 때리고, D, I는 각 이에 가세하여 옆에 서서 피해자에게 “저 씹할 놈 죽여버려, 너 그러다 죽는다, 야 씹할 놈아”라고 욕설을 하면서 때릴 듯한 태도로 위세를 과시하였다.

Accordingly, the Defendant assaulted the victim jointly with B, C, D, and E.
