A defendant shall be punished by imprisonment for not less than eight months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

1. On 22:20 on 23, 201, from around 22:20 to 22:50 on the same day, the Defendant, at the “D” restaurant operated by the victim C (hereinafter referred to as “C”) in Ulsan-gu, Ulsan-gu, Seoul-do, the Defendant: (a) attempted to have the customer, who was under the influence of alcohol by two female customers seated with two influenites; (b) attempted to throw the fluent female customers, who were on the knick; and (c) attempted to get the customer into the knick; and (d) attempted to get the customer into the knick.

Accordingly, the defendant interfered with the victim's restaurant operation by force.

2. 공무집행방해 및 상해 피고인은 위 1항 기재와 같은 날 23:15경 울산 남구 E에 있는 울산남부경찰서 F지구대에서 위 1항 기재 업무방해로 신고를 받고 출동한 경찰관들에 의해 현행범으로 체포된 다음 지구대로 인치되어 소파에 앉아 있던 중 바지를 입은 채로 소변을 보고, 소변이 민원인 책상 아래쪽 등에 스며드는 것을 방지하기 위하여 바닥에 신문지를 깔고 있는 위 지구대 소속 경찰관 G(28세)의 얼굴을 오른발로 1회 차 안경이 바닥에 떨어지도록 하고, 이를 제지하는 같은 지구대 소속 경찰관 H(27세)의 오른쪽 정강이를 이빨로 물어뜯고, 위 H의 복부를 1회 차고, “짭새 새끼야, 나가서 1:1로 붙자, 쳐 죽여 버린다”고 욕설을 하였다.
