1. 피고인 A, 피고인 B의 공동범행 피고인들은 함께 2012. 4. 30.경부터 2012. 5. 17.경까지 울산 울주군 H 2~3층에 있는 ‘I게림랜드’에서 청소년 이용불가 아케이드 게임물인 ‘아라비안포커’ 게임기 57대와 ‘파이럿스토리’ 게임기 45대를 설치하고, 종업원 C, D 등을 고용한 후 그곳을 찾은 불특정 다수의 손님들로 하여금 게임기에 동전을 투입하고 자동실행장치인 속칭 ‘똑딱이’를 이용하여 자동으로 게임을 진행하게 하여 일정한 게임룰에 따라 정해진 일정한 점수를 획득하게 한 후 손님들이 획득한 점수를 다시 이용할 수 있는 ‘게임이용권(쿠푼)’을 발급하여 주는 방법으로 영업을 하였다.
