A defendant shall be punished by imprisonment for not less than eight months.

Punishment of the crime

[Criminal Power] On July 25, 2012, the Defendant was sentenced to imprisonment for a violation of the Punishment of Violences, etc. Act (collective assault, deadly weapons, etc.) at the Daejeon District Court on January 21, 2014, and completed the execution of the sentence at the Daejeon Correctional Institution on January 21, 2014. On September 23, 2014, the Defendant was sentenced to two years of imprisonment for a violation of the Road Traffic Act at the Daejeon District Court on September 23, 2014, and the said judgment became final and conclusive on October 1, 2014, and is currently under probation.

【Criminal Facts】

1. On July 9, 2015, the Defendant interfered with business: (a) around 21:00, at the “E restaurant operated by the victim D (Inn, 54 years of age) located in Daejeon Seo-gu, Daejeon; (b) taken the alcohol in the cooling house into mind; and (c) made customers feel out of the restaurant, such as taking the alcohol in the cooling house, drinking it with the mind, and taking the bath for customers.

As such, the Defendant, by force, interfered with the victim’s business operation by force during a total of eight times from June 1, 2015 to August 19, 2015, such as the list of crimes in the attached Table.

2. On August 18, 2015, the Defendant: (a) around 12:00 on August 12, 2015, the Defendant: (b) was under the influence of alcohol to the Hsts G operated by the victim G in Daejeon Seo-gu, Daejeon, and was damaged by adding seven (1), one consignee, four (4), and 7 (7) in front of the market price on the ground that he was under the influence of alcohol to the Hsts G, which was operated by the victim G, and did not sell it.

3. Around August 18, 2015, the Defendant: (a) found the victim J (24 years of age) of Daejeon Tae-gu Daejeon-gu, Daejeon-gu, under the influence of alcohol at the KI; and (b) took advantage of the victim’s horse, the Defendant: (c) threatened the victim’s ship as a documentary, with the victim’s flag’s flag, and flag, with the victim’s flag’s flag, and flag, with the victim’s flag’s flag, by taking advantage of the victim’s flag, on the ground that the victim’s flag was unable to speak; and (d) assaulted the victim’s flag by taking advantage of his flag,

In this respect, the defendant carried dangerous objects and assaulted the victim.
