1. Defendant A is a game products related business entity running a juvenile game room with the trade name “G” on the F1st floor of Busan Jin-gu, Busan, and no one may provide game products with contents different from those rated by the Rating Board for distribution or use.

Game products are classified as follows: (a) a simple manipulation alone cannot be obtained regardless of the user’s ability; (b) a different picture out of three different pictures presented within a given time is divided into two different pictures; (c) if a person selects a correct answer, he/she obtains points at the same time; and (d) if he/she selects a correct answer at the next seven stages, he/she obtains 5,00 points at the next stage and receives free gifts from the same method.

Nevertheless, from October 23, 2012 to 19:20 on October 29, 2012, the Defendant established a 19 game machine in the above game room and operated the business. The Defendant installed a game work file with contents different from the rating contents and provided a large number of unspecified customers with a game work file using a pro rata method according to the probability set as a program file irrespective of the user’s ability.

As a result, the Defendant provided game products with contents different from those rated by the Game Rating Board for use.
