Reasons
1. Basic facts
A. The plaintiff was skid by C, D is the husband of the plaintiff and C's children, and E's representative director F is the birth family of the plaintiff.
B. On June 7, 2011, the Plaintiff and C concluded a sales contract with E Co., Ltd. (hereinafter “E”), stating that each of the land owned by the Plaintiff and C shall be sold at KRW 8,500,000,000 for the purchase price, and the down payment of KRW 240,000,000 for the intermediate payment on the date of the contract, KRW 560,000 for the intermediate payment, KRW 7,700,000 for the remainder payment, KRW 7,700,000 for the sale price generated after the new construction of the building on each of the above land (hereinafter “instant sales contract”).
C. On June 7, 201, the Plaintiff, C, and E entered into the instant sales contract and entered into a joint development agreement with respect to each of the instant land as follows (hereinafter “instant joint development agreement”).
Article 1 (General Provisions) A (Plaintiffs and C) and B (E) of the Framework Agreement provide, under this Framework Agreement, the basic principles of development and the rights, obligations and implementation methods of development between the parties with respect to the whole exhibition G, H and I (each of the instant lands), and the detailed conditions and details thereof shall be determined by separate contracts and special agreements, if necessary.
Article 2 (Price for Providing Site)
1. Eul shall be paid the price determined as seven billion won for the site price to Gap in return for a joint project;
2. Eul shall determine the profit of 1.5 billion won to Gap in return for a joint project and shall pay the price.
Article 3 (Contractor Relation)
1. B shall be deemed to be a full-time agent for land development and all of the development of the project site and follow-up management affairs as a good manager and receive gains from development in good faith;
2.B shall exercise overall control over all business affairs of the development project.
3. A shall provide B with the title continuously until completion for the main project of B.
