피고인은 2019. 8. 5. 10:37경 제천시 B에 있는 ‘C 정육점' 앞 노상에서 ‘주차해 놓은 차를 긁고 갔다’라는 112 신고를 받고 현장에 출동한 제천경찰서 D지구대 소속 경사 E으로부터 사건 조사를 위해 연락처를 알려고 하자 화가 나, E에게 "넌 누구편이냐, 넌 부모도 없냐."라는 등으로 소리치면서 갑자기 그곳 바닥에 드러누워 뒹굴고, 이에 E이 도로 통행을 위하여 피고인을 일으켜 세우려 하자 E을 향해 수회 발길질을 하고 바닥에서 일어나 E에게 “패버리겠다.”라고 하면서 위 식당 출입문 옆에 있던 대걸레를 손으로 집어 들고 E의 목 부위를 1회 내려치는 등 폭행하였다.
