Reasons
Punishment of the crime
On January 11, 2013, the Defendant was sentenced to five years of imprisonment for robbery and rape at Seoul High Court, and the said judgment became final and conclusive on January 19, 2013.
Athon January 5, 2009, the Defendant stolen Samsung Credit Card (Credit Card Number : C) of the victim, which was kept on the side of the driver's seat of the car driver's seat in the middle-gu Seoul Metropolitan Government at the implied Dong of the victim B (53 years old) around 15:00.
At around 16:12 of the same day, Samsung Credit Card Co., Ltd., which was stolen as above, obtained approval of oil price from E Co., Ltd. under the direct management of E Co., Ltd. located in Dongbcheon-si, Gyeonggi-do, by citing the victim’s Samsung Credit Card as one’s card and allowing it to be used unlawfully, and by allowing the employee of the gas station who believed it to be true to approve the total amount of KRW 1,00,000 as oil price, and acquired it by deceit.
B. At around October 15:34, 201, the Defendant collected the credit card (credit card number : G) of the Victim B owned by the Defendant, which was stolen in advance during the first floor cash withdrawal period set up in the Korea Livestock Cooperative, Namyang Livestock Industry Agricultural Cooperatives, dlimf, 66-3, Namyang Livestock Industry, and withdrawn KRW 700,000 for cash services, by inputting H’s “70,000 won” and password. At around 12:46 of the same day, the Defendant collected the credit card (credit card number : G) of the Japan Bank owned by the Victim under the same method at the aforementioned withdrawal period, and then withdrawn KRW 600,000 for cash services by inputting the “60,000” and “H”.
Accordingly, the defendant stolen a total of KRW 1,300,000 by withdrawing it, and used a stolen credit card.
