1. The defendant A shall be punished by imprisonment with prison labor for six months and by imprisonment with prison labor for four months;
2.Provided, That this judgment shall not apply.
Reasons
Punishment of the crime
The defendants are the main owner of the Gwangju Mine-gu C Apartment, and the victim D is the president of the above apartment house and the director of the E Island.
1. On September 23, 2016, the Defendants submitted a written accusation against D at the public service center of the Gwangju Mine Police Station located in 551 as the Gwangju Mine, Gwangju Mine, etc.
The contents are as follows: D’s change of the representative meeting room of an apartment building, which is a public facility of an apartment building, to the library room in around 2012, the Housing Act was violated because it did not report to the mine office without the consent of the residents, notwithstanding the consent of the residents, and it did not report to the mine office, and it used the library, which is an official facility of the apartment building, as if it were an individual facility, by stealing the F’s official seal, and forged and used the building use contract with the F’s official seal attached to the building use contract of the E Library for the purpose of exercising the right on May 2012. However, there was no fact that D violated the Housing Act or forged, or embezzled library subsidies.
Accordingly, the Defendants conspired to submit a written accusation for the purpose of having D receive criminal punishment as above, and filed a false accusation against D.
2. The Defendants of defamation changed their use without obtaining the consent of 2/3 of the occupants of the apartment complex from November 8, 2016 to November 9, 2016 without reporting the change of use, and forged a private document with the seal affixed to the agreement for the use of the ancillary facilities (lease) affixed to the owner of the resident representative meeting, and then affixed it to the Gwangju Tax Office, in the form A4 form from the above C apartment to the above C apartment from November 9, 2016.
