1. Basic facts

A. On October 13, 2010, Jinjin Industrial Co., Ltd. (hereinafter “Dinjin Industrial”) concluded a real estate security trust agreement with an international trust company (hereinafter “international trust company”) on the land listed in attached Table 1(1) (hereinafter “instant land”) and each building listed in attached Table 1(2) (hereinafter “each building of this case,” and “instant land and building” when combined with the instant land, and completed the registration of ownership transfer of the instant land and building by reason of the said trust to an international trust on the same day.

B. From August 20, 2013, an international trust proceeds with the process of public auction (hereinafter “instant public auction”) including the commencement of public auction for the instant land, buildings, etc. from around August 20, 2013. The Plaintiff participated in the instant public auction, entered into a contract to purchase the instant land and buildings on September 5, 2013, and completed the registration of ownership transfer on October 2, 2013.

다. 피고 아시아건설 주식회사(이하 ‘아시아건설’이라 한다)는 원고가 이 사건 토지 및 건물의 소유권을 취득하기 이전부터, 별지1 목록 제2의 가항 기재 부동산(이하 ‘제1건물’이라 한다)의 1층 중 별지2 도면 표시 ㉠, ㉡, ㉢, ㉣, ㉠의 각 점을 차례로 연결한 선내 ㉮부분 1,172.5㎡(이하 ‘제1부분’이라 한다)의 지붕을 철거하고 내부에 아시아건설의 집기들을 보관한 채 이를 점유하고 있고, 이 사건 토지 중 별지3 도면 표시 ㉠, ㉡, ㉢, ㉣, ㉠의 각 점을 차례로 연결한 선내 ㉮부분 14.4㎡(이하 ‘제2부분’이라 한다) 및 같은 도면 표시 ㉤, ㉥, ㉦, ㉧, ㉤의 각 점을 차례로 연결한 선내 ㉯부분 14.4㎡(이하 ‘제3부분’이라 한다) 각 지상에 컨테이너를 설치하여 이를 각 점유하고 있으며, 별지1 목록 제2의 다항 기재 부동산 이하...
