C. The reasoning for the court’s explanation on each of the above facts is the same as the reasoning of the judgment of the court of first instance, and thus, this is acceptable in accordance with Article 8(2) of the Administrative Litigation Act and the main sentence of Article 420 of the Civil Procedure Act.
Judgment
1) In the instant disposition, the term "in the course of education and training or performance of duty (including diseases in official duties)" in Article 4(1)6 of the Act on the Honorable Treatment and Support of Persons, etc. of Distinguished Service to the State refers to that military personnel or police officials are injured or ill in the course of education and training or in the course of performing duty (including diseases in official duties). As such, in order to be different from the above provision, there is a proximate causal relation between education and training or performance of duty and their injury or disease, and the causal relation between the injury and the injury should be proved by the assertion of such relations (see, e.g., Supreme Court Decisions 2009Du9079, Oct. 29, 2009; 2009Du9079, Oct. 29, 2009). In light of such legal principles, there is no lack of evidence to acknowledge that the Plaintiff was injured due to the instant accident, as well as the testimony of the first instance court for the first instance court.
