1. 2013. 5. 20. 23:20경 서울 동대문구 휘경동 7-18 동부간선도로 진입로 앞 도로에서 피해자 B이 운행하는 C 택시 승용차에 승차하여 가던 중 음주 단속으로 인하여 교통이 정체되자 화가 나 피해자에게 ‘야 개새끼야 씨발놈아 운전면허증이나 있냐’라고 욕설을 하면서 시비하였고, 이에 피해자가 경찰관에게 도움을 청하기 위해 택시에서 내리자 피해자를 따라서 하차한 후 당시 음주 단속을 하고 있던 순경 D, 음주 측정을 위해 정차 중인 여러 차량 운전자들이 듣고 있는 가운데 "야 짱개 새끼야, 이 개새끼야"라고 큰소리로 말하였다.
