피고인은 2012. 11. 7. 13:30경 부산 부산진구 B에 있는 ‘C’앞 노상에서, 술에 취해 피해자 D이 운영하는 가게 앞에 진열된 옥수수 뻥튀기와 채소류, 콩나물통을 집어던지고, 이에 피해자가 "왜 그러느냐"고 말하자 갑자기 가게에 있던 막걸리 상자를 들어 얼굴을 향해 폭행하려고 하는 등 가게에 손님이 들어오지 못하게 행패를 부려 약 35분간 위력으로 피해자의 정당한 업무를 방해하였다.
