A person shall be punished by imprisonment with prison labor for not less than two months for the crimes of Articles 2 and 3 as stated in the judgment of the accused, and by imprisonment with prison labor for not more than ten months.

3.『2014고단1355』 피고인은 E, F와 함께 2013. 7. 14. 05:00경 의정부시 G에 있는 ‘H’ 앞길에서, 피해자 I, 피해자 J, 피해자 K, 피해자 L 등 피해자 일행이 담배를 피우며 시끄럽게 떠든다는 이유로, E는 피해자 I의 뺨 부위를 수회 때리고, 주먹으로 피해자 L의 얼굴 부위를 때렸으며 발로 피해자 L의 어깨 부위를 밟은 후 우산으로 피해자 L의 가슴부위를 수회 찌르고, 피고인은 피해자들에게 ‘씨발놈들아 너희들이 뭐냐, 나는 신당동 깡패다’라고 말하면서 피해자 L의 얼굴과 몸통 부위를 주먹으로 수회 때리고, F는 피해자들을 일렬로 세운 후 우산으로 피해자들의 얼굴, 몸통, 팔 부위를 수회 때리고, 발로 피해자들을 걷어찼으며, 피고인도 우산으로 피해자들의 얼굴과 몸통 부위를 수회 때렸다.
