The defendant's appeal is dismissed.

1. The sentence imposed by the court below (one year and six months of imprisonment) is too unreasonable.

Although the Defendant has a favorable circumstance, such as the confession of the instant crime, and there is no special circumstance or change of circumstances that may be newly considered after the sentence of the lower judgment, the Defendant’s age, character and conduct, environment, motive, means and consequence of the instant crime, circumstances after the instant crime, and conditions of sentencing, etc., such as punishment, are considered as impeding the citizens’ awareness of sound labor by encouraging excessive gambling, and thus, requires strict punishment. In particular, the Defendant is not only responsible for the management of the illegal sports gambling site, etc. according to the direction of E, which escaped from G after being detained, but also for the instant crime, such as forcing its people to recruit its members in order to maximize their profits. The Defendant has a history of being subject to criminal punishment several times, there is no special circumstance or change of circumstances that may be newly considered after the sentence of the lower court, and considering the following circumstances, the lower court’s punishment is unreasonable, and the Defendant’s assertion is not reasonable.

3. In conclusion, the defendant's appeal is dismissed in accordance with Article 364 (4) of the Criminal Procedure Act since it is without merit. It is so decided as per Disposition.
