1. The Plaintiff (Counterclaim Defendant) against the Defendant (Counterclaim Plaintiff)

A. Attached Form 1 is indicated among the 5,177.4 square meters of land for C-sports at the Government-si.

A principal lawsuit and a counterclaim shall be deemed simultaneously.

1. Basic facts

A. D purchased a 5,177.4m2 (hereinafter “instant land”) from the Korea Land Corporation, and completed the registration of ownership transfer on November 11, 2003, and obtained a building permit from the Gu Government mayor on May 31, 2004, and ordered the instant construction of the instant land’s land’s neighborhood living facilities and sports facilities construction to CS Integrated Construction (hereinafter “CS Integrated Construction”) on October 4, 2004. On April 11, 2005, D subcontracted the portion of the civil engineering works among the construction works of the said building to CS Integrated Construction Co., Ltd. (hereinafter “CS Integrated Construction”).

B. Around August 2005 and around November 2005, Defendant Nitex Co., Ltd. (hereinafter “Defendant Nitex”) re-subcontracted the construction of soil facilities from the aforementioned Nitex (hereinafter “instant construction”).

C. From August 2005, Defendant A, while carrying out the instant construction from around 2005, installed the temporary materials, such as the sn beam beamline, on the instant land. From November 2005, Defendant C&T installed the temporary materials listed in the separate sheet 2 list leased from Defendant C&T, on the instant land, as indicated in the separate sheet 1.

D On December 3, 2005, on the sale of the instant land to Ageles, Co., Ltd. (hereinafter referred to as "Ageles") and on January 11, 2006, completed the registration of ownership transfer of the instant land to Ageles, and Defendant B received contracts from Ageex for the instant construction, and installed temporary materials, such as H beam beam, which is its own possession, on the instant land.

E. Defendant A’s failure to pay the construction cost to the C.S. Comprehensive Construction Co., Ltd., thereby preventing the construction cost from receiving the construction cost from the C.T.T.T., around January 10, 2006, the instant construction was suspended and the construction site was conducted with the C.T.
