1. The Defendant shall pay to the Plaintiff KRW 22,568,706 and the interest rate of KRW 15% per annum from October 24, 2017 to the date of full payment.
Reasons
1. Basic facts
A. The Plaintiff is a company that manufactures and sells steel products, and the Defendant is a company that runs the construction business, etc.
B. In October 2012, the Plaintiff entered into a contract with the Korea Land Construction Co., Ltd. (hereinafter “Korea Land Construction”), under which Korea Land Construction Co., Ltd. subcontracted from Geumho Construction Co., Ltd. and leased 235,440 km of the trial file by February 14, 2017, general Hnline 235,440 km and general Hn beam 66,176 km from March 21, 2017 to the construction site of this case as necessary for “the construction of this case” (hereinafter “instant construction”).
(hereinafter referred to as “each temporary material of this case” by combining the above temporary materials installed after lease.
However, after May 2017, the Defendant succeeded to the instant construction work after sub-subcontracting the instant construction from Hanto Korea Construction. The Plaintiff and the Defendant concluded a new lease agreement with the Defendant regarding each of the instant temporary materials established at the instant construction site by leasing and using it as it is, the contract amount was determined from Hanto Korea Construction to August 6, 2017.
After the completion of the instant construction, from July 3, 2017 to July 14, 2017, the period from July 3, 2017, before the expiration of the said contract, the Defendant returned 235,440 gg of the visual file of each of the instant temporary materials to the Plaintiff, and 66,022 g of the general Hstline from among the 66,176 gggs, and the Plaintiff examined and settled the same by ascertaining the temporary materials lost, damaged, or damaged under the said contract, and the amount to be settled therefrom are as follows:
