Reasons
Punishment of the crime
1. Defendant A
(a) Foods or additives that meet the standards and specifications for preservation shall be manufactured, imported, processed, used, cooked, or preserved in accordance with such standards, and foods or additives that fail to meet such standards and specifications shall not be sold or manufactured, imported, processed, used, cooked, stored, subdivided, transported, preserved, or displayed for sale;
Nevertheless, the Defendant, from the early April 2017 to the end of April 28 of the same month, preserved approximately 58 tons of “F”, which was determined as “F” in Gangnam-gu, Yangwon-gun E, not freezing (14°C, 17°C, 21°C), for sale purposes.
(b) No person who is not true or exaggerated shall place a label with regard to the names, manufacturing methods, quality, nutrition labelling, genetic materials, associations of food, etc. and food history tracking management labelling, and the nutrition of foods or additives is different from facts or exaggerated about raw materials, ingredients, and uses;
Nevertheless, the Defendant, from the early March 2017 to April 28, 2017, injected the Medition, which is the raw material of “G”, into the content of 3.22% to 3.48% at the place indicated in the foregoing paragraph, but indicated 6.9% on the packaging paper on the packaging paper.
