A defendant shall be punished by imprisonment for not less than one year and six months.

Punishment of the crime

From February 2, 2011 to February 20, 2013, the Defendant has been engaged in duties such as accounting and settlement of accounts, review of accounting resolution, receipt and disbursement of funds, management of passbooks of the company, etc. as the deputy head of the Korea Land and Housing Corporation (LH) Special Headquarters D in Sejong Special Self-Governing City.

The Defendant, from August 16, 2012 to January 22, 2013, withdrawn funds to be paid to the Public Procurement Service through several times, and consumed them for personal purposes. As a result, when the amount that was not paid to the Public Procurement Service was accumulated, the Defendant attempted to write the accounting resolution and withdraw the company’s funds on a large scale using the accounting resolution, and to use some of the funds for personal purposes, such as the payment of unpaid funds to the Public Procurement Service.

At around 16:00 on January 28, 2013, the Defendant entered the following: (a) the office of the Korea Land and Housing Corporation (LH) Special Headquarters D, located in Sejong Special Self-Governing City (LH) in Sejong Special Self-Governing City; (b) access to the above company’s financial information system without authority for the purpose of handling business affairs; (c) access to the foregoing company’s financial information system: Type A, draft department (A, and item (d) to the payment rate for materials (F, part), amount: 212,652,840 won: Daejeon Local Government Procurement Service; (c) the payment method; (d) the payment method; and (e) January 29, 2013; and (d) access the above company’s financial information system to the aforesaid company’s financial information system; and (e) approval of the electronic records to the account system under the name of the former head of the Korea Land and Housing Corporation (hereinafter referred to as the “Korea Land and Housing Corporation”).

The Defendant continues to use the above financial information system, and as such, is in the area of the party branch of Sungnam-gu, as if he completed one copy of the accounting resolution, which is an electronic record.
