1. The defendant shall pay to the plaintiff KRW 3,045,884 as well as 5% per annum from February 23, 2009 to June 2, 2015 and the next day.
Reasons
1. The following facts do not conflict between the Parties:
On February 23, 2009, the Plaintiff, after undergoing a heart-ladin operation at the Scze Hospital around 2006, was in use for a long time, filed an appeal for the pain of the part having the right side (hereinafter “the instant procedure”) with the Defendant’s Badin (hereinafter “Defendant’s Council member”) and the part having the right side (hereinafter “the instant procedure”).
B. On February 23, 2009, the Plaintiff received first aid from the Jeonnam University Hospital immediately after the Defendant’s invasion, and was transferred to the SBS Hospital for three weeks, and received a preserved treatment for the purpose of blood transfusion.
C. Even after the above preservation treatment, the Plaintiff continued to undergo an operation to remove the recitings that occurred in the left-hand body by being hospitalized in the Sveves Hospital around May 2010, and then remains in the left-hand top-hand body.
2. Occurrence of liability for damages;
(a) A patient who has undergone an in-depth test operation on the basis of responsibility is likely to cause blood transfusion because he/she takes ordinarily long-term anti-emergency drugs in order to prevent blood from being being in response to the test room, and thus, he/she is unlikely to undergo blood transfusion if he/she suffers from blood in his/her body.
However, in full view of the purport of the argument in Gap's statement, the plaintiff notified the defendant that he had been in the past a cardiopulmonary surgery at the time of the instant procedure, and that he was in the use of cardiopulmonary drugs and blood pressure. Therefore, the Defendant, a medical specialist, confirms the accuracy of the medicine that the Plaintiff is taking, and determines from a medical point of view, whether it is appropriate to conduct a cryprying procedure to the patient who takes the medicine.
