Punishment of the crime

1. Even if the Defendant received the down payment under the name of the number plate from the victim, it was planned to use it in the expenses of the Defendant’s office, living expenses, personal debt repayment, etc., so there was no intention or ability to purchase the number plate of the cargo for business use

Around August 21, 2017, the Defendant received KRW 20 million from the victim to the Cbank account (D) in the name of the Defendant, under the name of the number plate of the cargo vehicle.

Accordingly, the defendant was given property by deceiving the victim.

2. On August 2017, the criminal defendant against the victim E stated that the "G Motor Vehicle Trading Company in the F Building in Gwangju Mine-gu," located in the Hho Lake office, the victim E stated that "it is necessary to get off the number plate of the truck for business use from the company in female and female," and the victim E stated that "on September 2017, the above victim claimed the number plate of the truck, so he/she was placed in advance, and deposited KRW 20 million as soon as possible."

However, in fact, the defendant did not have secured the number plate of cargo vehicles that can be transferred to the victim, and even if he received the down payment under the name of the number plate from the victim, it is personal.
