1. We dismiss the part of the claim to nullify the disciplinary action of one-month suspension from office among the lawsuits in this case.

2. The defendant is the plaintiff.

Reasons

1. Basic facts

A. On March 1, 1998, the Plaintiff was appointed as a full-time lecturer at C University (hereinafter “D University”) operated by the Defendant as a department of rehabilitation treatment and full-time lecturer. On April 1, 2001, the Plaintiff was appointed as an assistant professor at the Department of Life Applied Science and worked as a life applied science department, nanotechnology chemical environmental engineering and assistant professor until September 30, 2006, respectively. On October 1, 2006, the Plaintiff was appointed as a nanotechnology and an associate professor, and served as an associate professor at the Cultural University from January 2, 2007 to November 30, 2009, and from December 1, 2009 to December 1, 2009, the Plaintiff is working as an associate professor at an educational graduate school curriculum.

B. On September 1, 2012, the Defendant issued a rejection disposition against the Plaintiff on the ground that: (a) on September 1, 2012, the Plaintiff’s examination of the professor promotion for the Plaintiff: (b) 75.09 points in the education field among the base points according to the Regulations on the Personnel Management of D University and the standards for the teaching evaluation; (c) 100 points in the research field; (d) each standard point (e.g., 60 points in the education field and 25 points in the research field); (e., 45 points as indicated below; and (e) 38.39 points below the base point, which are below the minimum necessary requirements for the teaching promotion; and (e) the Defendant satisfied the requirements for the rejection disposition against the Plaintiff on September 1, 2013, on the ground that the education field among the above base points was below 76.58 points in the education field; and (e) 100 points in the research field were below the base point; and (e) 405.242 points in the teaching guidance.

(hereinafter referred to as the "decision of refusal to promote professors of this case", including the disposition of refusal to promote professors of this case as of September 1, 2012 and September 1, 2013.

C. The Defendant’s disciplinary action against the Plaintiff on June 26, 2014, held a disciplinary committee on the Plaintiff on June 26, 2014, and “the Plaintiff faithfully performed his/her departure and withdrawal.”
