그러나 사실 피고인은 처음부터 피해자로부터 돈을 편취할 생각이었을 뿐 피해자에게 보내 줄 에어팟 프로가 없었다.
Nevertheless, the Defendant, at around 17:31 of the same day from the victim, received money of KRW 1.97 million from the victim to the F account (G) in the name of the Defendant, and received money from the victims on a total of six occasions as shown in the attached crime list (1) from around that time.
<2020고단990> 피고인은 2020. 3. 26.경 부산 사하구 H, I호에서 인터넷 D 카페 게시판에 ‘에어팟 프로 이어폰을 판매한다.’라는 취지의 글을 게시하고, 이를 보고 연락한 피해자 J에게 ‘돈을 송금해 주면 물건을 보내주겠다’라고 거짓말을 하였다.
그러나 사실 피고인은 처음부터 피해자 J로부터 돈을 편취할 생각이었을 뿐 에어팟 프로 이어폰을 보내줄 의사나 능력이 없었다.
