A defendant shall be punished by imprisonment for not less than eight months.

Criminal facts

1. On July 25, 2012, the Defendant made a false statement to the Defendant’s C office located in Songpa-gu Seoul building 415, stating that “The Defendant would lend KRW 40 million to E, as he/she needs to operate his/her factory, to the victim D, who is a private village of Songpa-gu, Seoul, to operate his/her factory. If so, he/she would pay interest of KRW 1.2 million per month and repay money until March 25, 2013.”

However, even if the victim receives the money, there was no intention or ability to lend the money to E, or to repay it.

The defendant received 40,000,000 won from the victim to the corporate bank account (F) in the name of E on the next 26.

2. The Defendant, at around 16:00 on July 25, 2012, without the authority to borrow money as described in paragraph (1) from the place described in paragraph (1) at issue: (a) around 16:00, without the authority to use the money from the foregoing D; (b) borrowed the money from the blank to the “certificate of rent: 40,000,000; (c) July 25, 2012; (d) monthly interest shall be three copies and the period for repayment shall be March 25, 2013. If the Defendant is unable to implement the promise, what legal measures may be taken; (c) on July 25, 2012: (d) the Defendant stated the name of Jung-gu Seoul Special Metropolitan City G apartment; (d) H, name: E; and (e) the Defendant’s prior seal affixed by the Defendant; and (e) the amount of the money borrowed to the issuer’s name “0,000,000 column”; and (e. 20, 70.

Accordingly, the Defendant forged each of the following: (a) a letter of borrowing, which is a private document on rights and obligations, and a cash receipt, which is a private document on certification of facts:
