Reasons
Punishment of the crime
The Defendant is a person in charge of registration in the “C law office” located in the Do-si, Jeollabuk-do.
1. On April 12, 2014, the Defendant, at the “C law office”, received documents for the establishment of a collateral security right by mail, such as the establishment of a collateral security right under the name of F, I, and the power of attorney, in order to obtain a loan from the head of the livestock finance team in the C law office, the Defendant received the registration of the establishment of a collateral security right under the name of F, I, M, and the right of attorney, in order to obtain a loan from the head of the livestock finance team in the C law office, 4141.2m2m2m2, G, 4014.5m2, J. 148m2, K, 2907m2, L. 407m2, L. 4010m2, and N44.3m2, a total of 4444m2m2, a total of the instant land (hereinafter collectively referred to as “the instant land”).
However, the Defendant: (a) received a request from P Co., Ltd., a joint joint and several guarantors and a guarantor to jointly and severally pay for the obligation to lend construction expenses incurred in the construction of double-generation farms to complete the registration of ownership transfer by April 15, 2014; and (b) received a request from P Co., Ltd., a joint and several guarantors and the right to claim for the transfer of ownership, which is not registered as a collateral security; and (c) used documents for the establishment of a collateral security in the name of F, I, and M,
around April 15, 2014, the Defendant entered this case’s land in the “C law office” real estate indication column by using a computer, and stated that “F, I, and M shall, as a person obligated to make a promise to sell and purchase the former real estate owned by him, promised to sell it to P Co., Ltd. under the following provisions,” and written “F on April 15, 2014,” and written “F’s seal” in the column of the person obligated to make a promise to sell and purchase, and affixed the F’s seal, stating “FR, Cheongnam-do, Cheongnam-do,” and written “I-do, Cheongnam-do, Cheongnam-do,” and affixed I’s seal.
